Terms of Service

1. Acceptance of Terms

By accessing or using Kelter Feed and Speed Calculator ("KFS", "the Service"), owned and operated by Kelvrix LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

KFS is a CNC machining feeds and speeds calculator that provides calculated cutting parameters based on user inputs. The Service includes AI-powered tips, subscription management, and related features.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating an account
• Notify us immediately of any unauthorized use of your account
• Not share your account with others or allow multiple users on a single account

4. Subscription and Billing

Paid subscriptions are billed in advance on a recurring basis (monthly, quarterly, or yearly). You authorize us to charge your payment method for all fees incurred. Subscriptions automatically renew unless cancelled before the renewal date. You must cancel your subscription before the billing date to avoid being charged.

5. Free Trial

New users may receive a 30-day free trial with full access to all features. To start a free trial, you must:

• Create an account
• Select a subscription plan (monthly, quarterly, or yearly)
• Provide a valid payment method

Your payment method will NOT be charged during the trial period. After the 30-day trial ends, your subscription will automatically begin and your payment method will be charged according to the plan you selected. To avoid being charged, you must cancel your subscription before the trial ends.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. The calculated feeds and speeds are recommendations only and assume optimal work holding and tool holding conditions. Users are responsible for verifying all parameters are appropriate for their specific equipment, materials, conditions, work holding setup, and tool holding configuration. We are not liable for any damage to equipment, materials, or injury resulting from use of the calculated parameters.

6a. Work Holding and Tool Holding Disclaimer

All calculations provided by KFS assume optimal work holding and tool holding conditions, including but not limited to:

• Properly secured workpiece with adequate clamping force
• Appropriate fixtures and vises for the material and operation
• Correct tool holder type and condition (collet, end mill holder, shrink fit, etc.)
• Proper tool engagement and minimal runout
• Machine rigidity appropriate for the cutting parameters

Suboptimal work holding or tool holding conditions may require significant reductions to the calculated parameters. Users must assess their specific setup and adjust accordingly.

7. Limitation of Liability

IN NO EVENT SHALL KFS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

8. Modifications

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

Privacy Policy

1. Information We Collect

We collect information you provide directly:

• Account information (name, email address)
• Payment information (processed securely by Stripe)
• Usage data (calculations performed, features used)

2. How We Use Your Information

We use collected information to:

• Provide and maintain the Service
• Process payments and manage subscriptions
• Send important notifications about your account
• Improve the Service and develop new features

3. Data Security

We implement industry-standard security measures to protect your data. Payment information is processed by Stripe and never stored on our servers.

4. Data Retention

We retain your data for as long as your account is active. You may request deletion of your account and associated data at any time through the Account Settings page.

5. Third-Party Services

We use the following third-party services:

• Stripe for payment processing
• OpenAI for AI-powered machining tips
• Replit for authentication

6. Your Rights

You have the right to access, correct, or delete your personal data. Contact us to exercise these rights.

Refund Policy

No Refunds Policy

Due to the digital nature of the Service and the 30-day free trial period provided:

• All subscription payments are non-refundable.
• You have 30 days during your free trial to evaluate the Service at no cost.
• If you do not wish to be charged, you must cancel your subscription before the trial period ends.
• Once a billing period begins, no refunds will be issued for that period.

Cancellation

You may cancel your subscription at any time through the Account Settings page or Stripe customer portal. Important notes:

• Cancellation must be completed before your billing date to avoid charges.
• After cancellation, access continues until the end of your current billing period or trial.
• Once charged, no refunds will be issued regardless of usage.

Your Responsibility

It is your responsibility to cancel your subscription before the billing date if you do not wish to continue using the Service. We send reminder notifications before your trial ends and before each billing cycle, but you are ultimately responsible for managing your subscription.

End User License Agreement (EULA)

1. License Grant

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.

2. Restrictions

You may not:

• Copy, modify, or distribute the Service or its content
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to develop a competing product
• Share your account credentials or subscription with others
• Use automated tools to access the Service

3. Intellectual Property

All content, features, and functionality of the Service are owned by Kelvrix LLC and protected by intellectual property laws. The calculation algorithms, user interface, and branding are proprietary.

4. Termination

We may terminate your license immediately if you breach these terms. Upon termination, you must cease all use of the Service.

5. App Store Compliance

If you access the Service through a mobile app:

• This EULA is between you and KFS, not the app store provider
• The app store provider has no obligation to provide maintenance or support
• The app store provider is not responsible for any claims related to the app

6. Governing Law

This Agreement is governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
